This summary is for convenience only. The numbered sections below are what is legally binding.

1. Acceptance of these Terms

These Terms of Use (the "Terms") form a binding legal agreement between you ("you", "user") and GameFound, operator of the website game-found.com ("GameFound", "we", "us", "our").

By accessing, browsing, registering an account on, or otherwise using the website (the "Service") you acknowledge that you have read, understood, and accept these Terms together with our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not use the Service.

2. Definitions

3. What the Service is

GameFound is an independent online catalogue of video games. We aggregate publicly available metadata from IGDB and live deal pricing from IsThereAnyDeal and present it through a search, filtering, and browsing interface. Signed-in users may keep a personal Library and Wishlist.

GameFound is not a marketplace. We do not sell games, process payments, ship products, or handle returns. Any purchase is a contract between you and the third-party retailer.

GameFound is not affiliated with, endorsed by, sponsored by, or partnered with IGDB, IsThereAnyDeal, any game publisher, any game developer, any retailer, or any third-party identity provider.

4. Eligibility and age

Consistent with Article 8 GDPR as implemented by Law no. 58/2019 in Portugal, you must be at least 16 years old to create an Account. Users under 16 may browse public Content only, and only if a parent or legal guardian permits it. If you are younger than 16 and have created an Account, or if you are a parent or guardian who becomes aware of such an Account, please contact us (see §18) and we will delete it.

5. Account registration, security, and suspension

  1. You may register one Account per person. Accounts are non-transferable. You are responsible for the accuracy of the information you provide.
  2. You are responsible for keeping your password confidential and for all activity under your Account. Notify us promptly if you suspect unauthorised access.
  3. You can delete your Account at any time from the Account Settings page. Deletion is scheduled with a 5-day grace window during which you can cancel without losing your data. After the grace window, your Account and all associated User Content (Library, Wishlist, display name, avatar) are permanently removed.
  4. We may suspend or close Accounts that violate these Terms, in particular §6 (Acceptable Use), or that we reasonably believe to be fraudulent, compromised, or associated with abuse of the Service. Where the breach is not manifestly illegal and admits of remedy, we will notify you and give you a reasonable opportunity to cure before acting, unless immediate action is necessary to protect the Service or its users.

6. Acceptable use

You agree, when using the Service, not to:

7. Your User Content

User Content on GameFound is limited. You do not publish reviews, comments, or public posts on the Service; the only personal Content you contribute is:

You retain all rights you already have in your User Content. By submitting it you grant GameFound a limited, worldwide, royalty-free, non-exclusive licence to host, store, transmit, and display that User Content solely to operate the Service for you. This licence ends when you remove the Content or delete your Account, except for any residual copies retained in routine backups for a limited period (§8 of our Privacy Policy).

We may remove User Content that, in our reasonable assessment, breaches these Terms, is manifestly unlawful, or is the subject of a valid takedown notice (see §15). Where feasible and lawful we will notify you of the removal and of your right to contest it, consistent with Article 17 of the Digital Services Act (Regulation (EU) 2022/2065, "DSA").

8. Third-party data and services

The Service depends on and displays data from third parties. Your use of the Service is also subject to the terms that govern those third parties when their data or services are involved:

9. Intellectual property

  1. The GameFound name, logo, interface, design, code, and structure are protected by copyright, database rights, and trademark law and are the property of GameFound or its licensors. You may not copy, reproduce, distribute, modify, or create derivative works of them without our prior written consent, except as permitted by mandatory law.
  2. Game metadata (titles, summaries, covers, release dates, company attributions, ratings) is licensed to us by IGDB and remains the property of IGDB or its sources.
  3. Deal pricing, store URLs, and the associated tracking parameters are licensed to us by IsThereAnyDeal and remain ITAD's (or its sources') property. We pass store URLs through unmodified to preserve ITAD's upstream affiliate relationships.
  4. Store names, logos, game titles, and box art shown on the Service are trademarks or copyrighted works of their respective owners. Their appearance on GameFound is nominative attribution for cataloguing purposes and does not imply any endorsement, sponsorship, or partnership.

10. Deals, prices, and third-party purchases

Prices shown on the Deals page are sourced from IsThereAnyDeal and may be inaccurate, out of date by up to an hour, or unavailable in your country. Always verify the price on the retailer's site before purchasing. Any purchase is a contract between you and the retailer; your consumer rights in that contract are governed by the retailer's terms and applicable consumer-protection law.

Store URLs may contain affiliate-tracking parameters operated by IsThereAnyDeal. ITAD may earn a commission when you purchase through those links. GameFound currently does not earn affiliate commission from deal clicks. If that changes, we will update these Terms and the Privacy Policy and disclose the change on the Deals page.

11. Fees

Use of the Service is currently free of charge. We do not operate a paid tier. If we introduce paid features in the future, those features will be governed by a separate agreement and the consumer-protection rules applicable to distance contracts under Decreto-Lei n.º 24/2014 will apply, including the statutory right of withdrawal where relevant.

12. Suspension and termination by us

We may suspend or terminate your access to the Service, in whole or in part:

Consistent with Article 17 DSA, we will, where applicable, provide you with a statement of reasons and the available redress options.

13. Disclaimers

The Service is provided on an "as-is" and "as-available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of satisfactory quality, fitness for a particular purpose, non-infringement, and accuracy. In particular, we do not warrant that:

Nothing in this section limits any rights you may have as a consumer under mandatory Portuguese or EU law which cannot be validly excluded by contract.

14. Limitation of liability

To the fullest extent permitted by law:

  1. our liability to you for losses arising out of or in connection with the Service is limited to foreseeable, direct losses that are a natural and probable consequence of our breach;
  2. we are not liable for indirect, incidental, special, consequential, or punitive losses, including loss of profit, loss of opportunity, loss of data (except where such loss is caused by our failure to meet our security obligations under applicable data-protection law), or losses arising from a third-party retailer's actions or omissions;
  3. nothing in these Terms excludes or limits our liability for (a) death or personal injury caused by our negligence, (b) fraud or fraudulent misrepresentation, (c) any liability that cannot lawfully be excluded under Portuguese or EU law.

Any claim against us must be brought within one year of the event giving rise to the claim, to the extent permitted by law.

15. Indemnity

You agree to indemnify and hold us harmless against any third-party claim, loss, or reasonable legal cost arising from (i) your breach of these Terms, (ii) your breach of any applicable law, or (iii) your infringement of a third party's rights through your use of the Service. This §15 does not apply to the extent the claim is caused by our own breach, negligence, or wilful misconduct.

16. Notice and takedown

If you believe Content accessible through GameFound infringes your rights or is otherwise unlawful, please email contact@game-found.com with:

We will review valid notices promptly and, where appropriate, act in accordance with Articles 16–18 DSA. We reserve the right to share your notice with the poster of the Content and with relevant authorities.

17. Changes to these Terms

We may revise these Terms from time to time. We will update the "Version", "Effective", and "Last updated" line at the top of this page and maintain a dated revision history at §21. Where a change is material and adverse to you, we will give you reasonable advance notice through the Service or by email, consistent with §22 of the Digital Services Act and applicable Portuguese law. Your continued use of the Service after the change takes effect constitutes acceptance of the revised Terms. If you do not accept a revision, you may delete your Account (§5).

18. How to contact us

For general questions about these Terms:

19. Governing law and jurisdiction

These Terms and any non-contractual obligations arising out of or in connection with them are governed by and construed in accordance with the laws of the Portuguese Republic, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Subject to the mandatory consumer-protection rules below, the courts of the District of Lisbon, Portugal have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service.

If you are a consumer habitually resident in the European Union, nothing in this section deprives you of the protection of the mandatory consumer-protection rules of the Member State in which you reside, and you retain the right to bring proceedings in the courts of that Member State as permitted by Regulation (EU) No 1215/2012.

20. Out-of-court dispute resolution (EU consumers)

If you are a consumer and we cannot resolve a dispute amicably, you may use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr/ to find a certified alternative-dispute-resolution body.

Consumers resident in Portugal may also refer a dispute to a Portuguese alternative-dispute-resolution entity listed at www.consumidor.gov.pt, including CNIACC (Centro Nacional de Informação e Arbitragem de Conflitos de Consumo) or the regionally competent centre, under Law no. 144/2015. We are not bound to participate unless required by law.

22. Miscellaneous

  1. Entire agreement. These Terms, together with the Privacy Policy and any notices referenced in them, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements on the same subject matter.
  2. Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision shall be interpreted so as to give effect, as closely as possible, to the original intent while remaining lawful.
  3. No waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
  4. Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, provided the assignee assumes our obligations to you.
  5. Force majeure. We are not liable for failures or delays caused by events beyond our reasonable control, including outages of upstream data providers (IGDB, ITAD), hosting or network infrastructure, or acts of public authorities.
  6. Language. These Terms are provided in English. If we publish translations, the English version prevails in case of conflict, except where Portuguese law requires otherwise for consumers resident in Portugal.
